Waters Of The U.S. (WOTUS)

The U.S. EPA and the U.S. Army Corps of Engineers promulgated a rule expanding federal jurisdiction over navigable waters. This new rule is an egregious expansion of federal jurisdiction.

Congress failed to pass a resolution in January to halt the overreaching Rule. Additional legislative and legal efforts will be utilized to end this federal regulation.

A U.S. Court stay is currently in effect.

Significance

Cause delays in obtaining federal Clean Water Act permits, impose more regulation, and will increase construction costs.
